Talbot County. Upon the twenty third day of October in the year of our Lord God Seventeen hundred and forty came John Higgins of Talbot County planter and brought a deed of sale with three indorsements thereon and prayed to have the same recorded amongst the records of Talbot County and Acording by the sd Deed with the indorsement thereon were upon this twenty third day of September in the year of our Lord God Seventeen hundred and forty afd Inrolled amongst the records of Talbot County as follows Vizt.

 

This Indenture made the eleventh day of August in the year of our Lord God one thousand seven hundred and forty Between Nicholas Lowe of Talbot County in the province of Maryland Gent and Margret his wife of the one part and John Higgins of the same County and province planter of the other part Witnesseth that the said Nicholas Lowe and Margret his wife for and in consideration of the Quantity of Twenty eight hundred pounds of good sound Leafe merchantable Tobacco in Cask to them in hand paid by the said John Higgins of the Sealing and Delivery of the so presents the receipt whereof they do hereby acknowledge and of Every part thereof do acquit and discharge the said John Higgins his heirs Executors and administrators for ever by these presents have given granted bargained sould [sold] released enfeoffed and confirmed and by these presents do clearly and absolutely do give grant bargain sell release enfeoff and confirm unto the said John Higgins his heirs and assigns for ever part of a tract of Land called Lowes Rambles[i] (taken up by Nicholas Lowe father to the present Nicholas Lowe and by him and by him a Pattent obtained for the same in the year of our Lord God 1699) Lying in Talbot County Beginning at the end of the north north west line of White Philips[ii] and running west south west twenty perches[iii] to Borams Range[iv] then with the said Land north west ninety five perches then across to the north end of the south east line of Little Bristol[v] then south east with the said land one hundred perches till you come opposite to the beginning then to the first tree or beginning containing by estimation twenty eight acres of Land be the same more or less, and all trees, under wood, Woods, common Common of pasture prophits [profits] commodities advantages emoluments[vi] and hereditaments whatever to the said parcel of Land belonging or in any ways appertaining or in or upon the same parcel of Land growing happening or arising and also the reversion and reversions remainder and remainders rents and services of the said premises of and every part thereof and also all the Estate right title Interest claime and demand whatsoever of them the said Nicholas Lowe and Margret his Wife of in and to the same premises and every part thereof, To have and to hold all and singular the said premises above mentioned and every part and parcell thereof with the appurtenances unto the said John Higgins his heirs and assigns to the only proper use and behoofe of the said John Higgins his heirs and assigns forever and the said Nicholas Lowe and Margret his Wife doth covenant and Engage unto the said John Higgins his heirs and assigns that the aforesaid Bargained premises is free and clear from all other bargains sales deeds of gifts grants Charges troubles an in Combrances [encumbrances] whatsoever, and also the said Nicholas Lowe and Margret his Wife for themselves their heirs and assigns the aforesaid parcell of Land and premises against them and their heirs and against all and every other person or persons Claiming any Right tittle Interest or estate by from or under them the said Nicholas Lowe and Margret his Wife to the said John Higgins his heirs and assigns shall and will Warrant and forever defend by these presents In Witness whereof the parties aforesaid the said Nicholas Lowe and Margret his Wife to this Indenture have set their hands and affixed their seals the day and year as above written. The Indorsements whch on the back of the Deed of Sale are as followeth Vizt

Talbot County. We the subscribers two of the Lord Proprietarys his justices for the County afd do hereby certify that the within mentioned Nicholas Lowe and Margret his Wife on the eleventh day of August in the year of our Lord  seventeen hundred and forty did personally appear before us and did acknowledge the within deed of Bargain and Sale and all the Lands hereditaments and premises what soever in the same deed contained unto the within named John Higgins his heirs and assigns for ever according to the form and effect of the same deed the aforesaid Margret Lowe being first privately examined apart out of the hearing of her Husband according to the Act of Assembly in tat Case made and provided In Witness whereof we have hereunto set our hands the day and year above written.                                      ThBozman ~     WThomas ~

[i] A John Higgins is listed in the Talbot County 1783 assessment as owning 28 acres of Lowes Ramble, in Bolingbroke [Hundred]

[ii] A tract of land

[iii] Land measurement equaling 16.5 feet

[iv] A tract of land purchased by John Higgins in 1730, from Thomas and William Berry. A John Higgins, Jr. purchased an additional 30 acres of Borams Range in 1789 from Thomas and Johannah Gordon

[v] A tract of land

[vi]  (1) To grant property in fee simple (2) Refers to all wages, benefits or other benefit received as compensation for holding some office or employment
