Of the other part, in consideration of the sum of two hundred and sixty dollars current money by the said John E. Kemp a house and lot in the village of Trappe, being the same property mentioned in the will of Mary Berridge deceased:  Item 2nd I give and bequeath also to my son Hugh M. Berridge my house and lot of land in the village of Trappe... on the condition nevertheless that the said Hugh M. Berridge shall pay unto my daughter Rebecca Louisa Higgins all the rents or profits arising therefrom annually, and in case of the death of said Rebecca L. Berridge it shall be the property of her child Mary Catherine Antoinette Higgins, her [only child]"

In the Dred Scott case, the Supreme Court declared no slave or descendant of a slave could be a U.S. citizen, or ever had been a U.S. citizen. The Supreme Court also ruled that Congress could not stop slavery in the newly emerging territories and declared the Missouri Compromise of 1820 (prohibiting slavery above 36th parallel) to be unconstitutional.
